Frostbite Terms of Service

1. Acceptance
By inviting, installing, accessing, or using Frostbite ("the Bot"), you agree to these Terms of Service.
If you do not agree, you must discontinue use of the Bot.
2. Eligibility
You must comply with:
- Discord's Terms of Service
- Discord Community Guidelines
- Applicable local, state, national, and international laws
Server administrators represent that they have the authority to install and configure Frostbite.
3. License
A limited, non-exclusive, revocable, non-transferable license is granted to use Frostbite solely for its intended purpose.
No ownership rights are transferred.
4. Ownership
All software, source code, branding, documentation, intellectual property, and associated services remain the exclusive property of the Frostbite developer unless otherwise stated.
5. Acceptable Use
You agree not to:
- Abuse or overload the service
- Attempt unauthorized access
- Reverse engineer or exploit Frostbite
- Circumvent moderation systems
- Use Frostbite for unlawful purposes
- Interfere with the service or other users
- Use Frostbite to violate Discord's Terms of Service
Violation of these Terms may result in suspension or permanent denial of service.
6. Automated Moderation
Frostbite performs automated moderation based on server configuration.
Automated systems are not perfect.
The developer is not responsible for:
- False positives
- False negatives
- Incorrect OCR results
- Incorrect scam detection
- Missed moderation actions
- User-generated content
Server administrators remain solely responsible for moderation decisions within their communities.
7. Availability
Frostbite is provided on an "AS IS" and "AS AVAILABLE" basis.
We make no guarantees regarding:
- Availability
- Uptime
- Reliability
- Performance
- Accuracy
- Compatibility
Features may be added, modified, restricted, or removed without notice.
8. Data Processing
Use of Frostbite is subject to the Frostbite Privacy Policy.
By using Frostbite, you acknowledge that information necessary for operation and moderation may be processed.
9. Suspension and Termination
We reserve the right to suspend or terminate access at any time, including for:
- Abuse
- Malicious activity
- Excessive resource usage
- Security concerns
- Violations of these Terms
- Violations of Discord's policies
Server owners may remove Frostbite from their server at any time.
10. Limitation of Liability
To the maximum extent permitted by law, Frostbite and its developer shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from use of the Bot.
This includes, but is not limited to:
- Data loss
- Incorrect moderation
- Downtime
- Lost profits
- Business interruption
- Server disruption
- API failures
- Third-party service outages
Our total liability shall not exceed the amount paid for use of the service during the preceding twelve (12) months. If no payment has been made, our liability shall be limited to the maximum extent permitted by law.
11. Indemnification
You agree to defend, indemnify, and hold harmless the Frostbite developer from any claims, damages, liabilities, losses, or expenses arising from:
- Your use of the Bot
- Your server's moderation decisions
- Violation of these Terms
- Violation of applicable law
- Content generated or uploaded by members of your server
12. Third-Party Services
Frostbite depends upon third-party services including Discord.
We are not responsible for outages, changes, or actions taken by those services.
13. Changes
We reserve the right to modify these Terms at any time.
Updated Terms become effective upon publication.
Continued use constitutes acceptance of the revised Terms.
14. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws applicable in the developer's principal jurisdiction, without regard to conflict of law principles.
15. Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
16. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement governing use of Frostbite.
